A bond is an instrument issued when a person is arrested and appears in court. During the first appearance in court, the person may be granted bail or may be allowed a bond hearing. In this case, the person is not detained by the court during the hearing but instead, the bondsman takes on the risk that the person will appear in court whenever needed.
The bond is given to the court in order to ensure that the accused will be present for all the court proceedings. It is also issued in order to keep the community around safe from any further problems by the accused. The price is fixed taking into account the seriousness of the crime that was committed. It also takes into consideration a few other factors such as the employment status as well as the family status of the accused.
When does the Hearing take place?
The hearing takes place during the first time that the accused is brought to court. This usually occurs within 24 hours of the person being arrested for the crime. During this hearing, it is necessary to hire a good criminal lawyer in order to get the best deal possible for a bond. At this hearing, the judge will also read you all the charges which have been filed against you.
In case the accused finds the price of the bond too high, a bond reduction hearing can be requested. In this case, the judge will decide if the price is valid and whether it can be lowered. Lowering of the total amount can be due to inability to pay the amount by the family, other external factors or simply due to a great argument by the defense attorney on the case. The final decision for the price lies in the hands of the judge who is presiding over the case. It is up to him to decide whether the amount is applicable for the crime that has been committed.
Once the bond has been paid, the accused is allowed to stay freely for the duration of the case. They are released from jail but they have to abide by certain laws and must always be present for every court hearing. If the accused does not turn up at the court when required, it can majorly affect the status of the case. A new crime of ‘Bond Jumping’ will also be filed against them.
